Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Public Safety Simulators, LLC ("PSS360," "we," "us," or "our"), a Georgia limited liability company with its principal place of business at 10 Glenlake Parkway, Suite 130, Atlanta, GA 30328, governing your access to and use of the PSS360 platform and all associated training simulators (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you are accessing the Service on behalf of an institution, you represent that you have the authority to bind that institution to these Terms.

Institutional agreements take precedence. Where an institution has executed a separate signed contract with PSS360, that contract governs the commercial relationship. These Terms apply to all platform use not otherwise addressed by such a contract.

2. Who May Use the Service

The Service is not open to the general public. Access is granted exclusively to:

  • Instructors and administrators manually provisioned by PSS360 pursuant to a signed institutional contract.
  • Students (trainees) who access the platform via links or provisioning credentials arranged by their institution’s instructor. Students do not register independently.

You must be at least 13 years old to use the Service. Users between 13 and 18 must have the authorization of their educational institution, which is responsible for ensuring any required parental consents are in place under applicable law.

3. Accounts and Access Credentials

Instructor accounts are created and managed by PSS360. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at info@pss360.net if you become aware of any unauthorized use of your account.

Session access links issued to students are single-use or session-scoped credentials. You must not share, redistribute, or publish these links beyond the intended student population.

4. Permitted Use

The Service is licensed for use as an educational training tool within public safety programs. Instructors and institutions may use the Service to:

  • Conduct training sessions with enrolled students
  • Review session transcripts, scores, and performance metrics
  • Export data for internal reporting and academic record-keeping

5. Prohibited Uses

You agree not to:

  • Reuse, reproduce, publish, distribute, or sell any PSS360-authored content, including scenario scripts, scoring rubrics, assessment content, or training materials, whether in original or modified form.
  • Use the Service or any outputs from it for commercial purposes outside the scope of your institution’s contract with PSS360.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive source code or underlying models from the Service.
  • Record, capture, or redistribute simulation sessions or AI-generated content for purposes outside your institution’s authorized training program.
  • Circumvent, disable, or interfere with security features of the Service or attempt to gain unauthorized access to any part of the platform or its infrastructure.
  • Use the Service in any manner that violates applicable federal, state, or local law.
  • Impersonate any person or entity, or misrepresent your affiliation with any institution.

6. Intellectual Property

All content, software, scenario scripts, assessment materials, scoring methodologies, trademarks, and other materials made available through the Service are the exclusive property of Public Safety Simulators, LLC or its licensors and are protected by applicable intellectual property laws.

Nothing in these Terms transfers any ownership interest in PSS360's intellectual property to you. Your right to use the Service is a limited, non-exclusive, non-transferable license that terminates when your authorized access ends.

AI-generated simulator outputs (transcripts of training scenarios, scored responses) produced during your sessions do not constitute PSS360's proprietary scenario content and may be retained by your institution for educational record-keeping purposes.

7. AI-Powered Simulations

The simulators use large language model AI to generate dynamic training scenarios. Outputs are generated automatically and may vary between sessions. PSS360 makes no warranty that AI-generated scenario content is factually accurate, complete, or appropriate for any specific operational or certification purpose beyond its intended use as a training exercise tool.

AI outputs are educational exercises, not legal advice, operational guidance, or a substitute for official agency policy and training curricula. Institutions remain responsible for ensuring their training programs meet applicable regulatory, accreditation, and professional standards.

8. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Fees, Billing, and Cancellation

Access fees, payment terms, renewal conditions, and cancellation rights are governed entirely by the signed contract between PSS360 and your institution. These Terms do not create any independent payment obligation, refund right, or cancellation right. If you have questions about billing, contact your PSS360 account representative or email info@pss360.net.

10. Termination

PSS360 may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if the governing institutional contract terminates or expires. Upon termination, your right to access the Service ceases immediately. Sections 5, 6, 11, 12, 13, and 14 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PSS360 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PSS360, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL PSS360'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOUR INSTITUTION TO PSS360 IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless PSS360 and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your use of the Service in a manner not authorized herein; or (c) your institution’s breach of its contract with PSS360.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms that is not resolved by the parties shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there. Notwithstanding the foregoing, disputes between an institution and PSS360 regarding the institutional contract shall be resolved as specified in that contract.

15. Changes to These Terms

PSS360 may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice to institutional contacts via email. Continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes.

16. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any signed institutional contract, constitute the entire agreement between you and PSS360 regarding the Service.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No waiver. PSS360's failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment. You may not assign or transfer any rights or obligations under these Terms without PSS360's prior written consent. PSS360 may assign these Terms freely.
